Terms of Service

Visions of Darkness is founded on a platform of freedom of artistic expression. Nevertheless, it is privately owned and maintained by me. The content here is created by adults, for adults. As an artist, you can post whatever you want. As a viewer, you must be prepared to encounter a wide range of different subjects, some of which you may find distasteful.

As artists who specialize in dark themes and controversial subject matter, we tend to walk a fine line when depicting the relative age of our characters. The only key indicator that they've past puberty is how well endowed they are, and even then, there can still be the question of just how far into adulthood they've grown. As such, we have to rely on our own judgment when deciding whether to share more questionable subject matter with our peers, and the public.

Here in the US, the legal age of adulthood is 18. Anyone under 18 is a minor. United States Code states that digital or computer-generated images that are indistinguishable from an actual minor are illegal. That is the legal definition we follow here on VoD.

With that in mind, there is only one cardinal rule: Depictions of children in any situation are stricty prohibited.

Images that involve child nudity are categorically prohibited, and any attempt to post or link to child pornography will result in an immediate and permanent ban with no appeal.

All artists must ensure that figures used in renders look at least 18. I realize that can be somewhat subjective, but please use common sense.

Please note that fairies, pixies, elves, and other human-like creatures will be assessed as if they were human, and must also appear to be 18 years or over.

Similarly, any ages of participants specifically mentioned in text where sexual activity or extreme peril is involved, must be 18 or over. This is a requirement of this site that does not always apply to text-only sites. Please respect it.

Images containing violence, or bestiality (human/animal sexual contact) are allowed as long as they are clearly rendered 3D images or drawings, and not photographs. Artists are asked to post and/or label such images appropriately so that viewers cannot stumble across them unwittingly.

Photographs posted on the site should be the artist's own work or should be posted with the express permission of the photographer.

Photo-manipulations are more questionable. My position is that if the majority of the image is the artist's, then the image can be posted. If, for example, the base image is a 3D render created by the artist who has then added some photographic elements to it, then the image is allowed.

If the base image is a photograph to which the artist does not own the copyright, and they have then simply added something like a noose to the image, then the image is not allowed.

This is not a *legal* definition of whether the images are acceptable or not, but my own criteria. If you're not sure, please contact me before posting.

With the exception of celebrity homages, artists should refrain from using recognizable images of real people in their work, although this is not a hard and fast rule.

If you discover that a recognizable likeness of your face has been used in any photo-manipulation or another type of picture displayed on the site, and believe that this has violated your privacy or caused you distress in any way, please contact me with the details, and I will arrange for the image to be removed from the site if appropriate.

Deepfakes of celebrities and real people are strictly prohibited and will be removed.

Please be aware that the artists who post images here retain the legal copyright to those images. It is immaterial that this is a free site - the images must not be posted elsewhere without the permission of the artist.

Similarly, members must not post images by other artists, or claim them as their own (either explicitly or implicitly). Making some small changes to the source image (such as removing the true artist's signature and replacing it with a new one) does NOT make the image the property of the member.

Members may post text-only links to images by other artists for the purpose of discussing said images. Any posts must be made in News & Discussion, include a brief description of said links, and why you believe said images merit discussion.

The Galleries are reserved for artwork created by members of VoD. Members may post text-only links to images by other artists in the Galleries for the purpose of comparing their own, inspired work to said images. Any links must be accompanied by the member's own work.

Commissioned work is not allowed on VoD unless it's posted by the artist themselves. Otherwise, the artist is robbed of any potential feedback on their own work while the client is unduly praised for the commission.

Visions of Darkness respects the intellectual property rights of others and expects its members to do the same. At my discretion and in appropriate circumstances, I may remove artwork submitted to the site. If you believe the copyright in your work or in the work for which you act as an agent has been infringed through VoD, please contact me and I will arrange for the image to be removed from the site.

Freedom of expression is encouraged here, including the occasional robust discussion of controversial issues. Please remember that this is an art forum, not a debate club. Also be aware that abuse and harassment, racial intolerance, extreme views from either end of the political spectrum, and sexual or other forms of aggression, will NOT be tolerated. Repeat offenders risk being permanently banned.

Other forms of inappropriate conduct may also lead to membership being revoked without warning.

Members caught attempting to post spam will be banned immediately. Members registering using meaningless Spam bot style IDs may be banned, regardless of whether they are actually Spambots or not.

Advertising of sites containing material related to 3D art is allowed, as is advertising other types of art sites. Links to message boards and galleries advertised here must have a legal right to any artwork they host. If you've come here just to advertise your site, and not to contribute in other ways, then you are not welcome here. If you're simply advertising porn sites with no artistic merit, then your post will be removed. Fetish producers are prohibited from advertising here.

All members can add links to their own sites in their signatures, but the links and the signatures must be text only.

I take a dim view of piracy at Visions of Darkness. It is theft, pure and simple. Members caught contributing to the illegal and immoral practice of re-distributing commercial models or texture sets, whether in the capacity of providers or as consumers, and whether or not they are profiting from it personally, will be immediately banned. The same goes for people advocating or advertising any form of software theft.

It may be illegal for you to post, view, or be "in possession of", certain types of subject matter, including bestiality or snuff, depending on your location and any applicable laws. It is your responsibility to find out the exact legal position that applies to you in this regard. As a viewer, you may encounter both types of an image here, along with other extreme content, including BDSM, torture, forced sex, and similar subjects. Such content makes up a very small part of the overall work posted on the site, but if it is not your cup of tea, or if you are at all worried about the legal implications of being inadvertently exposed to such material, then please do not join the site. If you have already joined the site and discover that the content is not to your liking then please leave and ask for your membership to be terminated. I will ensure that all relevant user data is deleted.
